By using Ignighter services you agree to adhere to these terms. Ignighter reserves the right to modify these Terms without notice. If you do not agree to these Terms, you cannot use Ignighter - plain and simple. Ignighter may, from time to time update these Terms without notice. The most recent Terms are located on this page (you're reading them now...) at http://www2.ignighter.com/Page/Terms/. You should revisit this page occasionally to review these Terms and Conditions. The Agreement sets out the terms under which Ignighter services (the "Services") are provided to you by us through the Ignighter Application/Site. By registering with Ignighter, you become a member of the Service (a "Member"), and you agree to be bound by the terms and conditions of this Agreement (the "Terms") for as long as you continue to be a Member.

The content, arrangement and layout of Ignighter.com, including, but not limited to, the trademarks, service marks, package designs, text, art work, graphics, images, buttons, screen shots, other content, and the compilation of the foregoing ("Content") are the property of Ignighter Inc., except where otherwise noted, and are protected from copying, imitation, communication, or simulation under domestic and international laws and are not to be reproduced, communicated, displayed, distributed, or transmitted without the express written permission of Ignighter Inc.

You understand and agree that you have no ownership rights to your Ignighter account. Ignighter may cancel your account and delete all content associated with your account at any time and without notice if we deem that you have violated the terms of this agreement or for any other reason. Ignighter assumes no liability for any information removed from our application/site for violating these terms. You may also cancel your account at any time. This cancellation takes effect immediately. After a cancellation, Ignighter will remove all content associated with your account. We reserve the right to permanently restrict access to our products and services to members who have had their accounts cancelled.

To become a Member you must register with us. When and if you register to become a Member, you agree to provide accurate, current and complete information about yourself as prompted by our registration form ("Registration Data"), and to maintain and update your information to keep it accurate, current, and complete. You agree that we may rely on your Registration Data (including everything from uploaded photos to informational content) as accurate, current and complete. You acknowledge that if your Registration Data is untrue, inaccurate, not current or incomplete in any respect, we reserve the right to terminate this Agreement and your use of the Site. By becoming a Member, you represent and warrant that you are at least 18 years old, which is the minimum required age to become a Member. However, we cannot guarantee that each Member is at least the required minimum age, nor do we accept responsibility or liability for any content, communication, or other use or access of the Application/Site by persons under the age of 18 in violation of these Terms.

You are solely responsible for your interactions with other Members. You understand that Ignighter does not in any way screen its Members, nor does Ignighter inquire into the backgrounds of its Members or attempt to verify the statements of its Members. In no event shall Ignighter be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of Ignighter, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other registered users of Ignighter or persons you meet through Ignighter. You agree to take reasonable precautions in all interactions with other Members of Ignighter, particularly if you decide to meet offline or in person. In addition, you agree to review Ignighter's Code of Conduct prior to using Ignighter. You will not include in your profile any offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, or any confidential information of any third person, and you will not post any photographs or other images containing nudity or such personal information. Ignighter reserves the right, but has no obligation, to reject any profile or photograph or image that does not comply with these prohibitions. You will not impersonate any person or entity. You will not "stalk" or otherwise harass any person. You will not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through Ignighter. You will not transmit any chain letters, spam or junk email to other Members.

From time to time this service may include, offer or initiate winks, collect or send messages or chat from Market Researchers (Featured Members) identified as single men or women or groups of men or women seeking "Chat", "Email Correspondence" or any other forms of communication for market research and/or customer experience and/or quality control and/or compliance purposes. Market research information is used to provide analysis, feedback, trends, patterns, social commentary and information in the aggregate and aides in the process of monitoring our system for compliance with our operating standards and Code of Conduct. Any member may adjust their "Settings" to opt out of contact with Featured Members. Accordingly, Market Researchers (Featured members) will NOT be conspicuously identified and will NOT physically meet or agree to be contacted outside of the Ignighter System. We do not guarantee the authenticity of any member using our site. Any interaction or communication with Market Researchers (Featured Members) is independent of, and separate from, our general database of Member's seeking personal or physical or other kinds of encounters or introductions. You accept and acknowledge that any written statements, mail messages or instant messages made by Market Researchers (Featured Members) are provided for "entertainment" purposes that serve to enhance the user's personal online experience. You further understand, acknowledge, and agree that, from time-to-time, Market Researchers (Featured Members) may contact both free users and paid users via computer-generated Instant Messages or emails for purposes of encouraging further or broader participation in our site's services and/or to monitor user activity. These messages may be transmitted to multiple recipients at the same or similar time(s). If you do not wish to be contacted by Market Researchers or Featured Members go to 'Settings' and check the "No" box that corresponds with: "Check this box if you do not wish to be contacted by Market Researchers or Featured Members", then UPDATE. In addition to Market Researchers (Featured Members) some images on Ignighter are for demonstrative purposes only and do not reflect actual members.

You agree to indemnify and hold Ignighter Inc. and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees harmless from any alleged claim or demand, including reasonable attorney fees, made by any third party due to or arising out your use of the Service, your connection to the Service, your violation of the Terms of Service, or your violation of any rights of another, whether you are a registered user or not. The user is solely responsible for his or her actions when using the Service, including, but not limited to, costs incurred for Internet access.

Ignighter provides assistance and guidance through its customer care representatives. When communicating with our customer care representatives, you may not to be abusive, obscene, profane, offensive, sexist, threatening, harassing, racially offensive, or otherwise behave inappropriately. If we feel that your behavior towards any of our customer care representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your membership and you will not be entitled to any refund of unused subscription fees.

Ignighter's 1 month membership plan bills at $19.99/mo once every month. Ignighter's 3 month membership plan bills at $44.97 once every 3 months. Ignighter bills you through an online account (your "Billing Account") for use of the Service. You agree to pay Ignighter all charges at the prices then in effect for any use of the Service by you or other persons (including your agents) using your Billing Account, and you authorize Ignighter to charge your chosen payment provider (your "Payment Method") for the Service. You agree to make payment using that selected Payment Method. Ignighter reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

Most subscription plans to the Service consist of an initial period, for which there is a one time charge, followed by recurring period charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. IGNIGHTER MAY SUBMIT PERIODIC CHARGES (E.G., MONTHLY) WITHOUT FURTHER AUTHORIZATION FROM YOU, UNTIL YOU PROVIDE PRIOR NOTICE (CONFIRMED IN WRITING UPON REQUEST BY IGNIGHTER) THAT YOU HAVE TERMINATED THIS AUTHORIZATION OR WISH TO CHANGE YOUR PAYMENT METHOD. SUCH NOTICE WILL NOT AFFECT CHARGES SUBMITTED BEFORE IGNIGHTER REASONABLY COULD ACT. TO TERMINATE YOUR AUTHORIZATION OR CHANGE YOUR PAYMENT METHOD, GO TO ACCOUNT SETTINGS.

YOU MUST PROVIDE CURRENT, COMPLETE AND ACCURATE INFORMATION FOR YOUR BILLING ACCOUNT. YOU MUST PROMPTLY UPDATE ALL INFORMATION TO KEEP YOUR BILLING ACCOUNT CURRENT, COMPLETE AND ACCURATE (SUCH AS A CHANGE IN BILLING ADDRESS, CREDIT CARD NUMBER, OR CREDIT CARD EXPIRATION DATE), AND YOU MUST PROMPTLY NOTIFY IGNIGHTER IF YOUR PAYMENT METHOD IS CANCELED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR USER NAME OR PASSWORD. CHANGES TO SUCH INFORMATION CAN BE MADE ATACCOUNT SETTINGS. IF YOU FAIL TO PROVIDE IGNIGHTER ANY OF THE FOREGOING INFORMATION, YOU AGREE THAT IGNIGHTER MAY CONTINUE CHARGING YOU FOR ANY USE OF THE SERVICE UNDER YOUR BILLING ACCOUNT UNLESS YOU HAVE TERMINATED YOUR SUBSCRIPTION FOR THE SERVICE (CONFIRMED BY YOU IN WRITING UPON REQUEST BY IGNIGHTER).

The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method (the "Payment Method Provider"). If Ignighter does not receive payment from your Payment Method Provider, you agree to pay all amounts due on your Billing Account upon demand.

If the amount to be charged to your Billing Account varies from the amount you preauthorized (other than due to the imposition or change in the amount of state sales taxes), you have the right to receive, and Ignighter shall provide, notice of the amount to be charged and the date of the charge at least 10 days before the scheduled date of the transaction. Any agreement you have with your Payment Method Provider will govern your use of your Payment Method. You agree that Ignighter may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle.

Your Ignighter subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current non-promotional subscription rate. To change or resign your subscription at any time, go to account settings. If you resign, you may use your subscription until the end of your then-current subscription term; your subscription will not be renewed after your then-current term expires. However, you won't be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

Your non-termination or continued use of the Service reaffirms that Ignighter is authorized to charge your Payment Method. Ignighter may submit those charges for payment and you will be responsible for such charges. This does not waive Ignighter's right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially subscribed to the Service.
